Participation Agreement, Liability Release, and Waiver (“Agreement”)

I hereby acknowledge and agree to the following terms and conditions as a participant in activities offered by Lūneh Yoga LLC (“Lūneh”), including but not limited to yoga classes, puppy yoga classes, pilates classes, sculpt classes, meditation classes, reiki sessions, life and professional coaching, soundbaths, breathwork sessions, and the purchase and use of wellness retail products (“Lūneh Activities”):

Representation of Age and Authority

I represent and warrant that I am at least eighteen (18) years of age and legally competent to enter into this Agreement.

For purposes of this Agreement, a “Minor” or “Minor(s)” means any participant under the age of eighteen (18). If I am registering or signing on behalf of any Minor(s), I represent and warrant that I am the parent or legal guardian of such Minor(s), or otherwise have full legal authority to execute this Agreement on their behalf.

I acknowledge that this Agreement applies fully and equally to me and to any Minor(s) I register, and I agree to be legally bound on behalf of myself and such Minor(s).

Acknowledgment and Assumption of Risk 

I understand that participating in Lūneh Activities and related activities involves inherent risks, including but not limited to physical exertion, emotional release, equipment-related risks, slipping or falling, exposure to communicable illness, interaction with other participants, and the possible risk of injury or illness.

I voluntarily and knowingly assume all risks associated with my participation and, if applicable, the participation of any Minor(s) I register, in Lūneh Activities.

Acknowledgment and Assumption of Additional Risks for Participation in Puppies & Poses Classes (“Puppy Classes”) 

I understand that participation in Puppy Classes involves additional inherent risks, including but not limited to slipping or tripping injuries, interaction with animals (scratches, bites, unpredictable behavior), allergic reactions, and incidental contact from third parties. I voluntarily assume all such risks on behalf of myself and any Minor(s) I register.

Minimum Age and Supervision Requirements

For all Lūneh Activities other than Puppy Classes, participants must be at least fourteen (14) years old. Participants who are 14 or 15 years old must have a Parent or Legal Guardian book the class, sign this Agreement, and have an adult over the age of 18 present in class at all times. I represent and agree that for every three (3) Minor participants who are 14 or 15 years old and registered under my authority, there will be at least one (1) responsible supervising adult present and actively supervising them during the Lūneh Activities. Participants who are sixteen or seventeen (16 or 17) years old, must have a Parent or Legal Guardian book the class and sign this Agreement. 

For Puppy Classes, participants must be at least ten (10) years old. Participants who are between ten and fifteen (10–15) years old must have a Parent or Legal Guardian book the class, sign this Agreement, and have an adult over the age of 18 present in class at all times. I represent and agree that for every three (3) Minor participants who are ten to fifteen (10-15) years old and registered under my authority, there will be at least one (1) responsible supervising adult present and actively supervising them during the Puppy Classes.  Participants who are sixteen or seventeen (16 or 17) years old, must have a Parent or Legal Guardian book the class and sign this Agreement.

Lūneh reserves the right to deny participation or remove any participant(s) if adequate supervision is not provided. No refunds will be issued for removal due to noncompliance.

Physical and Mental Health

I acknowledge that I am solely responsible for assessing my own physical and mental health, and, if applicable, the health of any Minor(s) I register, and determining whether participation in Lūneh Activities is appropriate.

I affirm that I (and any Minor(s) I register) are physically and mentally capable of participating in such activities. I acknowledge that Lūneh does not provide medical advice and that I have consulted a healthcare professional, if I have any concerns.

Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Lūneh, its owners, members, instructors, employees, contractors, volunteers, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, causes of action, damages, losses, or expenses, including attorney’s fees, arising out of or related to any injury, illness, death, or property damage sustained by me or any Minor(s) I register, whether caused by the negligence of the Released Parties or otherwise, while participating in Lūneh Activities.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including attorney fees, that they may incur arising out of or related to my participation in Lūneh Yoga LLC activities.

I agree to indemnify, defend, and hold harmless the Released Parties from and against any loss, liability, damage, claim, demand, or cost (including reasonable attorney’s fees) arising out of or related to: (1) my participation in Lūneh Activities; (2) the participation of any Minor(s) I register; (3) any breach of this Agreement; and (4) any failure to properly supervise Minor(s) under my authority.

Photo and Video Release 

I grant permission to Lūneh and its representatives to photograph or record me and/or any Minor(s) I register during Lūneh Activities and to use such media for promotional, advertising, marketing, website, and social media purposes without compensation. I waive the right to inspect or approve the finished media and release any claims related to such use.

Understanding and Voluntary Agreement

I have carefully read and fully understand the terms of this Agreement. I voluntarily agree to its terms and conditions, intending to be legally bound thereby, and I acknowledge that I am signing this Agreement freely and without any inducement or assurance of any nature.

Miscellaneous

This Agreement survives the conclusion of any Lūneh Activities. If any part of this Agreement is deemed unenforceable, the rest remains in effect.
